Non-Precedence of the Calhoun Beach Club Apartments
The Calhoun Beach Club Apartments do not represent a legal precedent for a decision about an apartment project on the Weisman property. The history of this controversial project is important. Height limits including the Shoreland Overlay District limit of 36 feet were adopted by the City shortly after a 26-story project on the site was proposed.
On December 21, 2005, the law firm of Faegre & Benson issued a legal opinion describing the history of the Calhoun Beach Club Apartments approval, and why the City’s approval of this project does not represent a legal precedent for a decision about the size and height of a real estate project on the adjacent Weisman property at 2622 West Lake Street.
